* One of the key expectations from the 56th meeting of the GST Council is the decision on rate rationalisation on various goods and services. Some of the important items likely to be on the agenda are GST rates on health and term life insurance premiums, charges collected by food delivery apps, drones, clarity on applicability of GST on charges collected by municipalities for granting FSI etc.
* A key expectation from 55th meeting of the GST Council was a discussion and decision to qualify the services provided by intermediaries to foreign clients as exports of services. However, there was no decision on this. The industry would be looking forward to a decision on this issue in the upcoming meeting of the GST Council. This amendment would bring an end to various ongoing disputes on this issue, mainly involving the services provided by the back offices and GCCs to foreign clients, who claim such services as exports of services while the tax authorities dispute these claims by treating their services as intermediary and subject to tax in India.
* An important area for the GST Council would be to assess the progress in setting up the GST Appellate Tribunal (‘GSTAT’) and take decisions, where required, to expedite the operationalisation of GST Appellate Tribunal. This is particularly important since presently the taxpayers are approaching the High Courts against the orders issued by the first appellate authority in the absence of the GSTAT, leading to increase in the pendency of the matters before the High Courts."
