There is a high possibility of implementation of Labour Codes in the near future. BJP has worked out a 100 days agenda of the new government if it takes charge at Centre post-election. This list may include the unfinished agenda of NDA-II, with Labour Codes being in the top priority list. Government has already approved 4 Labour Codes in both Houses of Parliament in 2019 and 2020. These codes subsume 29 current central laws relating to wages, social security, occupational safety, and industrial disputes. The Government has to only notify the date of entry into force of these codes, post which all the employers have to comply with this new law.
The codes will have impact on the employer-employees’ obligations/compliances relevant for all functional groups in an organisation such HR, Finance, tax, payroll and legal in some manner. Below are some of the provisions in the Codes that may impact overall cost for employers, if not attended timely:
1. Classification of employees/workers
2. New definition of wages for computation of all statutory dues and minimum wages
3. Gratuity payment for fixed term employees and its retrospective impact
4. Overtime provisions
5. Enhanced obligations in case of principal employer of third-party staff
6. Social security coverage for gig workers
