Jaya Thakur, who filed a plea for the independent working of the Election Commission, condemned the government over Chief Election Commissioner (CEC) Bill on December 13.
She said, “This is a very bad decision of the government for the public. This is a way to destroy the democracy. We have filed a petition earlier. We appealed to the Supreme Court that the Election Commission should be an independent body. There should not be any outer0020involvement and pressure. Therefore, a committee was formed under which the Chief Justice of India, the Prime Minister, and the Leader of Opposition were kept. Now, they introduced a Bill in which they have removed Chief Justice of India and kept some of their nominees. So, it is an attempt by the government to run this (ECI) in its way. It is a big threat to our democracy.”
The Rajya Sabha on Tuesday passed the legislation on the appointment of the Chief Election Commissioner and other Election Commissioners, while the Opposition walked out of the proceedings after marking its objection to the proposed law.
The bill provides for the appointment, qualifications, search committee, selection committee, term of office, salary, resignation and removal, leave, and pension of the Chief Election Commissioner and other election commissioners.
The Supreme Court, in a writ petition, declared that the appointment of CEC and ECs shall be made by the President based on the advice tendered by a committee consisting of the Prime Minister, the Leader of Opposition in the Lok Sabha or the leader of the largest opposition party in the House and the Chief Justice of India. The bill will replace the Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991.
